1. Scope & Subject Matter
1.1 These Terms of Service ('Terms') govern the use of the mobile application
Findig AI ('the App') by users ('User' or 'you').

1.3 Findig AI is an AI-powered assistant for technical diagnostics, repair, automotive, and DIY projects. It combines local on-device capabilities (knowledge base / RAG) with cloud AI processing.
1.4 The agreement is concluded upon downloading and installing the App from the Apple App Store or Google Play Store. No user registration or account creation is required (Zero-Login).
2. Service Scope & Availability
2.1 The Provider offers the App with its current feature set.
2.2 Upon initial installation, the User receives a complimentary starter package of Findig AI tokens to test cloud AI features.
2.3 An active internet connection is required for cloud-based functionality (e.g., advanced AI diagnostics, web research, visual analysis).
2.4 While the Provider strives for maximum uptime, continuous uninterrupted service cannot be guaranteed. Scheduled maintenance, security patches, or outages of upstream cloud/AI infrastructure providers may result in temporary downtime.
2.5 Access to cloud services requires running the official, unmodified App on a supported device with an original operating system. To ensure IT security and protect backend infrastructure against abuse, the Provider employs automated integrity and security attestation mechanisms. Access to cloud features may be restricted or denied on modified devices (e.g., via rooting, jailbreaking, or emulator environments) or when security attestation fails.
3. In-App Purchases, Token Consumables & Pricing Table
3.1 Additional token packages ('Consumables') may be purchased within the App. Tokens serve as a usage-based unit of account for consuming cloud-based AI services.
3.2 Billing and payment processing are handled exclusively through the respective app store platforms (
Apple App Store / Apple Inc. or
Google Play Store / Google LLC). The respective terms and conditions of Apple and Google apply. All purchases are one-time transactions; no subscription is created and no automatic renewals occur.
3.3
Pricing Table / Token Consumption:Token consumption depends on the nature and complexity of the requested feature:

Chat Responses (Text Diagnostics): Billed based on actual model usage (input and output tokens). Typical consumption ranges between approximately 150 and 500 tokens per message.

Technical Diagrams & Visuals (Image Generation): Flat rate of
3,000 tokens per generated image.
•
Live Web Search & Real-Time Research (Google Search Grounding): Flat rate of
1,500 tokens per web search query.
•
Hands-Free Mode (Real-Time Voice Streaming): Minute-by-minute billing based on active voice connection and transmission duration.
3.4
Link to Anonymous Support ID: Because the App operates without registration (Zero-Login), token balances are tied cryptographically to the device. As digital consumables ('Consumables'), purchased tokens are bound to the local app installation and cannot be restored or transferred to other devices following uninstallation. Users can view and copy their Support ID in the App Settings.
3.5 Unused tokens do not expire during active use of the App. Unused tokens are non-refundable and cannot be redeemed for cash.

Refunds: Statutory cancellation and refund requests for in-app purchases are governed by and must be submitted directly to Apple or Google in accordance with their respective store refund policies.
4. CRITICAL SAFETY WARNING & LIABILITY DISCLAIMER FOR REPAIRS
4.1
Nature of AI-Generated Content: All diagnostic recommendations, instructions, wiring schematics, torque specifications, and repair advice provided by Findig AI are generated by artificial intelligence. AI models may occasionally produce incorrect, inaccurate, or outdated information ('hallucinations').
4.2
No Substitute for Professional Expertise: App content is provided strictly for informational and guidance purposes. It is never a substitute for consulting certified professionals (e.g., master mechanics, licensed electricians) or referencing official original manufacturer service manuals.
4.3
High-Risk & Safety-Critical Work: Working on electrical installations (especially high-voltage EV/hybrid systems), braking systems, steering components, airbags, fuel/gas lines, or structural vehicle parts poses severe risks of injury, electrocution, or death. Such work must never be performed solely on AI advice and must only be executed by qualified, certified technicians adhering to all applicable safety and occupational hazard standards.
4.4
Limitation of Liability:a) The execution of any repair and the application of any advice provided by the App is done entirely at the User's own risk and discretion.
b) The Provider is liable without limitation for intent, gross negligence, personal injury, death, or mandatory statutory liability (such as under applicable Product Liability Acts).
c) For simple negligence regarding material contractual obligations (cardinal duties), the Provider's liability is limited to typical, foreseeable contractual damages.
d) In all other cases, liability for property damage, financial loss, vehicle damage, or consequential repair expenses resulting from reliance on AI-generated advice is explicitly excluded.
4.5
Linked External Content & Web Research: Where the App provides references or links to third-party websites as part of its responses or web research, these are provided purely as non-binding source references. The Provider has no control over the content, availability, or legality of external third-party websites and assumes no liability or warranty for them. Information obtained from third-party web sources does not replace verifying official manufacturer documentation.
5. Intellectual Property & Acceptable Use
5.1 The Provider grants the User a revocable, non-exclusive, non-transferable license to use the App on supported devices in accordance with these Terms.
5.2 Users agree not to:
• Decompile, reverse engineer, or disassemble the App or its communication protocols, except where expressly permitted by mandatory law;
• Use automated scrapers, bots, or unauthorized API clients against the server gateways;
• Circumvent or tamper with integrity, security, or attestation mechanisms of the App or its server interfaces;
• Use the App for unlawful, dangerous, or abusive purposes.
5.3 The Provider is entitled to technically block or reject requests from clients that fail security attestation or exhibit signs of tampering, manipulation, or automated scanning without prior notice. User claims regarding service availability, damages, or token refunds in connection with unauthorized, modified, or manipulated access are excluded.
6. Modifications to Terms
The Provider reserves the right to modify these Terms for legitimate reasons (e.g. legal changes, feature enhancements, technical adjustments). The current version is always accessible in the App and on the website.
7. Governing Law & Jurisdiction
7.1 These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers residing within the European Union, mandatory statutory consumer protection laws of their country of residence remain unaffected.
7.2 If any provision of these Terms is deemed invalid or unenforceable, the validity of the remaining provisions shall not be impaired.
